We, at PNS ADVANCED STEEL TECHNOLOGY, INC. (PNS ASTech or the Company), value and respect the rights to privacy of our existing and potential customers, suppliers, business partners and other persons with whom PNS ASTech or any of its group companies maintains or is considering to create a business relationship (the business partners). It is our obligation to notify our business partners, their individual representatives and other third parties on how we collect, process and safekeep personal information as well as to inform such parties of their rights in accordance Republic Act No. 10173 and its implementing rules and regulations (the “Data Privacy Act”).
PNS ASTech may collect personal information which may include, among others: (a) name and personal particulars such as contact details, address, birthdate, and education; (b) government ID details; (c) employment details; and (d) business interests and assets. These may be obtained through any of the following: (a) Availing of our products and services (such as requesting for quotations, filling out a form, placing an order, etc.); (b) Responding to queries and verifying customer identity; (c) Customer surveys for the improvement of our products and services; (d) Emails and letters; and (e) Information from our business partners or through other organizations (for example, insurance companies, government institutions, etc.). By providing personal information through the abovementioned channels or means, it is understood that any individual owning the information is allowing the Company to collect, use and share information with our business partners or other third parties, subject to statutory requirements.
All personal information provided to PNS ASTech are used to conduct our everyday business purposes, for marketing, or to perform our obligations arising from contracts entered into with our business partners. We generally do not seek to collect or otherwise process sensitive personal information but where it becomes necessary to process such type of sensitive personal information for any reason, we will seek the consent of the data subject concerned, except where processing of such information is permitted by law or provided to government or public authority or when necessary for the establishment of, compliance with, exercise of or defense of legal claims.
PNS ASTech may likewise disclose personal information to the following recipients or categories of recipients: (a) our directors, officers and employees and any person who correspond to such positions, (b) our external advisors such as attorneys, accountants and tax advisors; (c) group companies of PNS ASTech and their staff and advisors with whom PNS ASTech needs to share the data for purpose of processing; (d) other business partners and their staff and advisors with whom PNS ASTech needs to share the data for the purpose of processing; (e) governmental agencies, boards, commissions, officers, officials or entities exercising legislative, judicial, regulatory or administrative functions; or (f) other persons where required or permitted by law. Recipients of personal information may be located in countries and areas outside of the Philippines but in such case, PNS ASTech and the external recipient(s) in said countries shall execute pertinent data transfer agreement(s) which will protect the personal data so transferred under such terms and conditions consistent with the Data Privacy Act and/or as may be required under pertinent rules and regulations.
We take the privacy of one’s personal data seriously, both in paper and electronic form. Therefore, we store information in such a way that it will not be misused, modified, interfered, lost or disclosed to unauthorized users through the implementation of technical solutions, security practices and processes such as but not limited to the following: (a) document storage security policies; (b) security measures to control access to our systems and premises; (c) limitations on access to personal data; (d) data privacy training for our employees; and (e) electronic security systems, such as firewalls, data encryption and transmission of data through a secured file transfer protocol, as applicable.
The information is kept and maintained in our custody up to a certain period or as long as necessary for the purpose for which they were collected or as required by laws and regulations. Though we have set a specified period to remove or clear the data in our system, safety measures are still in place to safeguard and uphold whatever data due for disposal and for preservation.
To ensure that our partners will handle in the same manner we handle and protect the information, we established a strict selection process to ensure that we will only share data with partners who can demonstrate sufficient organizational, technical and physical security measures who can protect the personal data.
Personal information provided to us are subject to correction, modification or deletion. It is the right of the individual owning the personal data to inquire or obtain a copy of the personal information provided to us. We may modify or amend this Data Privacy Notice from time to time to keep up with any changes in relevant laws and regulations applicable to us or how we collect, use, protect, store, share or dispose of personal information.
This Data Privacy Notice as published on the Company’s website or as provided to you through any means is deemed incorporated by reference in any communication with business partners or other persons. It is understood that your continued access to our network of websites or use of the Company’s products, services, facilities and channels will constitute your acceptance of the contents of this Data Privacy Notice as the same may be revised or updated from time to time.
